Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility and KYC Compliance

To use our Platform, you represent and warrant that you are at least 18 years of age and have full legal capacity to enter into this Agreement.

2.1 Know Your Customer (KYC)

TradeCapAI complies with global Anti-Money Laundering (AML) standards. We reserve the right to verify your identity at any time. This may include requesting:

• Government-issued photo ID (Passport, Driver's License).
• Proof of address (Utility bill, Bank statement).
• A live selfie verification.

Failure to provide this information may result in the freezing of your account and funds.

2.2 Restricted Jurisdictions

Services are not available to residents of the United States of America, North Korea, Iran, Syria, and other sanctioned jurisdictions as defined by the OFAC.

3. AI Arbitrage & Trading Risks

Our "AI Arbitrage Bot" executes trades automatically based on price discrepancies across exchanges. While we strive for profitability, you acknowledge the inherent risks involved.

3.1 No Guarantee of Profit

Past performance of the TradeCapAI algorithm is not indicative of future results. The cryptocurrency market is highly volatile. You acknowledge that you may lose some or all of your invested capital.

3.2 Technical & Execution Risks

You agree that TradeCapAI is not liable for losses caused by:

• Latency/Slippage: Price gaps closing before a trade execution is finalized due to network congestion.
• Exchange API Downtime: Third-party exchanges (e.g., Binance, Kraken) going offline or changing their API limits.
• Network Fees: High blockchain gas fees that may eat into arbitrage margins during peak times.

4. Referral Program Policy

Our 50-Generation Referral System is designed to reward legitimate community building. We have zero tolerance for abuse.

4.1 Active Status

To receive referral commissions, you must maintain an "Active" status, defined as having a minimum personal investment of $100 equivalent in crypto assets.

4.2 Anti-Stacking & Self-Referral

Creating multiple accounts under your own referral link ("Stacking") to artificially inflate generation depth or earn commissions on your own deposits is strictly prohibited. Our AI fraud detection system monitors IP addresses and device fingerprints.

Penalty: Immediate permanent ban of all associated accounts and forfeiture of all accumulated commissions.

4.3 "Pyramid Scheme" Disclaimer

TradeCapAI is a trading platform, not a recruitment scheme. Commissions are generated from trading profits (profit-sharing) and trading volume, not solely from new deposits. If no trading activity occurs, no referral commissions are generated.

5. Deposits and Withdrawals

5.1 Freedom of Funds

You may withdraw your principal investment at any time ("Freedom of Funds"). However, to ensure platform stability and security:

• Cold Storage Delay: Large withdrawals (> $50,000) may require up to 24-48 hours for manual processing from our cold storage wallets.
• Network Fees: Users are responsible for all blockchain network fees associated with deposits and withdrawals.

5.2 Refund Policy

Once a trade has been executed by the AI on the blockchain, it cannot be reversed. Therefore, we do not offer refunds on trading losses or executed transaction fees.

6. Prohibited Activities

When using the Service, you agree NOT to:

• Use the Service for money laundering, terrorist financing, or any illegal activity.
• Attempt to reverse engineer, decompile, or hack the AI trading algorithm.
• Use automated scripts or "bots" to interact with our website (excluding our own provided tools).
• Spread FUD (Fear, Uncertainty, and Doubt) or false information about the platform in public communities.

7. Limitation of Liability

To the maximum extent permitted by law, TradeCapAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service;
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein;
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party.
